Description: 

The subject of Legislation in the Health Sector constitutes a fundamental pillar for understanding the legal framework that supports the healthcare system. In this course, students are introduced to the essential aspects of the health system. The scope of competence within the Law on the Organization of Healthcare Professions is explored in detail, providing a clear understanding of the responsibilities and competencies of the different actors within the healthcare field. Additionally, the legal responsibility that falls on healthcare professionals, both in the exercise of their functions and in clinical decision-making, is thoroughly examined. Students will gain a deep knowledge of the regulations and laws that rule medical practice and healthcare, allowing them to understand the legal framework in which they operate and make ethical and responsible decisions in their future professional careers.

Objectives: 

The objectives of this course are indicated below:

1.- Understand the regulation of the healthcare system in Catalonia in order to establish legal foundations that allow practical problems of the profession to be addressed.

2.- Distinguish between the level of ethical reflection in professional practice and the legal?juridical level, as well as understand the legal framework of patients? rights.

- Overview of the Healthcare System

- Main Healthcare Regulations

- Scope of Competences within the Law on the Regulation of Healthcare Professions (LOPS)

- Legal Liability in the Healthcare Sector

Methodology: 

The course Legislation in the Health Sector is delivered using a combination of teaching methodologies: lectures to convey the fundamental theoretical concepts of the course, and practical sessions where challenges related to healthcare legislation are presented and solved through individual or group activities.

Evaluation: 

Students will be assessed through a continuous and global evaluation of knowledge and competencies, including the analysis of practical cases and written reflections, as well as attendance, participation, and engagement in class, complemented by a final exam to assess the integration of learning outcomes.

Evaluation Criteria: 

Assessment will consider participation in practical activities, acquisition of theoretical knowledge, and the ability to apply it to real situations in the healthcare sector, including the regulation of the Catalan healthcare system, the legal foundations of the profession, patients’ rights and duties, and ethical reasoning in professional practice.
